You must be at least 18 years old to use 1Works. By using our platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into these terms. For university deployments, users must meet the institution's eligibility requirements.

3. Account Registration and brAInID

To use 1Works, you must:

• Provide accurate and complete information for your brAInID
• Maintain the security of your account credentials
• Complete identity verification as required
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

Your brAInID serves as your verified digital work identity. You are responsible for maintaining the accuracy of your credentials and professional information.

4. Platform Usage

You agree to use 1Works only for lawful purposes. You may not:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Engage in fraudulent activities
• Harass or harm other users
• Manipulate the platform, AI agents, or matching algorithms
• Create multiple brAInIDs or accounts to abuse the system
• Misrepresent your skills, credentials, or work history

5. Platform Services

1Works provides the following core services:

• brAInID - Verified digital work identity with blockchain-anchored credentials
• Work Canvas - Task execution and project management environment
• Skill Twin - AI agent that learns your work patterns and builds your Cognitive Work Profile
• Talent Exchange - Task marketplace for matching talent with opportunities
• Instant Payments - Escrow-governed payment processing

6. Payments and Transactions

By using our payment system, you acknowledge:

• Payments are processed through escrow-governed mechanisms
• Funds are released upon task or milestone completion
• You are responsible for applicable taxes on earnings
• Payment disputes are resolved through the platform's dispute resolution process
• We do not provide financial advice

7. Task Completion and Disputes

When participating in tasks through Work Canvas or the Talent Exchange:

• Complete tasks according to the agreed specifications
• Communicate professionally with all parties
• Resolve disputes through the platform's resolution process
• Accept that platform decisions on disputes are final
• Understand that task completion data contributes to your Cognitive Work Profile

8. AI Agents and Skill Twin

By using Skill Twin and other AI agents on the platform:

• You understand that AI-generated suggestions are assistive and not a substitute for professional judgment
• You are responsible for reviewing and validating AI outputs before acting on them
• AI agents operate within the governance policies set by your institution (for university/enterprise users)
• Your interactions with AI agents may be used to improve your Cognitive Work Profile

9. Institutional Deployments

For university and enterprise deployments of brAIn:

• The institution's governance policies apply within University/Enterprise Mode
• Users must comply with both platform terms and institutional policies
• Data handling follows the institution's data governance framework
• Personal Mode data remains under individual user control

10. Intellectual Property

All content on 1Works, including but not limited to text, graphics, logos, AI models, and software, is owned by 1Works or its licensors. You retain ownership of content you create, but grant us a license to use it on the platform for service delivery and improvement.

11. Privacy and Data

Your use of 1Works is subject to our Privacy Policy. You acknowledge that your Cognitive Work Profile is portable and can travel with you across institutions and employers.

12. Disclaimers

1Works is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Specific outcomes, earnings, or task matches
• Accuracy of AI-generated insights or recommendations
• Compatibility with all devices or environments

13. Limitation of Liability

To the maximum extent permitted by law, 1Works shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or opportunities arising from the use of our platform.

14. Indemnification

You agree to indemnify and hold harmless 1Works from any claims, damages, or expenses arising from your use of the platform or violation of these terms.

15. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms. You may also terminate your account at any time, subject to completing any outstanding obligations. Upon termination, you may export your brAInID data and Cognitive Work Profile.

16. Changes to Terms

We may modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.

17. Governing Law

These terms are governed by applicable laws. Any disputes will be resolved through arbitration or the courts of competent jurisdiction.
